[RxPG] New Delhi, April 3 - The Delhi High Court Tuesday called the file of the central government recommending President's medal to senior police officer Amodh Kanth and a subordinate officer for their prompt action and exemplary service during the 1984 riots in the capital.
Acting on a petition by riot-victim Amrik Singh, Justice B.D. Ahmed asked the Union home ministry to submit to it by April 23 the file relating to the recommendation of the President's medal to Kanth, then a deputy commissioner of police - in central Delhi and Paharganj police station's in-charge, Inspector S.S. Manon.
Singh alleged in his petition that Kanth, now a joint commissioner of police, and S.S. Manon, now an additional DCP, were awarded President's police medal in June 1985 after falsely representing to the President that they had nabbed 16 militants after a gun battle at Paharganj.
'Kanth and Manan are guilty of murdering Narinder Singh, a relative of the petitioner, and implicating him and his family members in false criminal cases by branding them as criminals, terrorists, miscreants and murderers,' alleged the petition filed by senior counsel H.S. Phoolka.
The police had arrested 16 members of Singh's family including his parents, five women and three minors on Nov 5, 1984. Two infants of six months and one and half years too were also with the arrested family, but were not included in the list of accused.
All the members were released on bail on Nov 13, 1984 by the sessions court, the petitioner said.
Recalling the troubled days in the wake of assassination of late prime minister Indira Gandhi Oct 30, 1984, the petitioner said that his uncle Amir Singh rushed to the Paharganhj police station to seek police protection after his family saw riotous mob heading towards their house.
'The mob, however, caught my uncle and lynched him in front of the family,' the petitioner said.
The petitioner said his father Fakir Singh fired a few shots in the air from his licensed gun to scare away the attacking mob.
The police, however, nabbed Singh's family members and charged them with killing two persons, Krishen Bahadur Gurung and Mangal, who had been shot dead in front of their house.
The subordinate court later acquitted Singh and his family members of murder charges on Dec 8, 1988 as the Central Forensic Science Laboratory - could not prove that the bullets fired at both Gurung and Mangal were from Singh's licensed gun.

The petition has sought the court's direction to the government to withdraw President's medal conferred on Kanth and Manon for falsely representing alleged criminal act as 'exemplery deed'.
