[RxPG] By using this website ("THE SITE") you agree to the terms set out below. If you do not agree with the whole or any part of the terms set out below you must not use the Site.
Clause 1
By using THE SITE you show that you understand and acknowledge that no legal relationship is created between you and THE SITE, RxPG , its officers, agents and/or employees through your use of the Site.
Clause 2
All content, design, data, software and underlying source code on the Site is the property of RxPG and/or its suppliers.
Clause 3
All copyright, patents, patent applications, database rights, rights in inventions and rights in the software, data or content relating to THE SITE shall be owned by and vest absolutely in RxPG and/or its suppliers.
Clause 4
All comments and forum posts are responsibility of the posters and they are apparently the copyright owners for them.
Clause 5
You can not use this site to publicise/propagate/advertise any group, service or net resource of any definition without the written consent of the RxPG. If you are found doing so, your account will be promptly disabled and your access to THE SITE will be banned by banning your IP address.
Clause 6
You may download, store, print and copy selected portions of THE SITE, provided you:
6.1. Only use the Downloaded Content for your personal, non-commercial, use or to further your business dealings with THE SITE.
6.2. Do not publish or post any part of the Downloaded Content on any other website.
6.3. Do not publish or broadcast any part of the Downloaded Content in or on any form of storage or retrieval media.
The clause 6 should be null and void for any part of THE SITE if there is a clear notice of download or storage restrictions on that page and/or section of THE SITE.
Clause 7
Except as expressly stated above, none of the content, design, data, software and underlying source code on the Site may be downloaded, reproduced, republished, linked to, posted, performed, distributed, transmitted, transferred, translated, sold or modified, without the express written permission of The RxPG.
Clause 8
Any trademarks, service marks and logos displayed on the Site (the "Trademarks") are registered and unregistered Trademarks of The RxPG or its licensors and may not be used without The RxPGs written permission.
Clause 9
ENTIRE AGREEMENT
9.1. These Terms and Conditions embody the entire understanding and agreement between the parties as to the subject matter of these Terms and Conditions.
9.2. No oral explanation or information provided by any party or its officer, employee, agent or adviser to another:
9.2.1. affects the meaning or interpretation of these Terms and Conditions; or
9.2.2. constitutes any collateral agreement, warranty or understanding between any of the parties.
9.2.3. No waiver of any of the provisions of these Terms and Conditions by a party shall be effective unless made in writing addressed to the other parties and duly signed by the party making the waiver.
Clause 10
MUTUAL AGREEMENT
The parties recognise that it is impracticable to make provision for every contingency that may arise in the course of performance of the provisions of these Terms and Conditions and accordingly declare their intention that these Terms and Conditions shall operate among them with fairness and covenant and agree with each other that they shall act reasonably at all times in carrying out their respective obligations and use all reasonable endeavours to ensure that full effect be given to the terms of these Terms and Conditions in the spirit in which it was agreed.
Clause 11
ASSIGNMENT
These Terms and Conditions shall be binding on the parties hereto and their respective successors and assigns.
Clause 12
NO PARTNERSHIP
Unless otherwise specifically agreed in writing, nothing in these Terms and Conditions or in your participation in THE SITE in any capacity imply any relationship between RxPG and you other than that of service provider and customer. No relationship of agency, partnership, joint venture, employment, or franchise shall be construed.
Clause 13
NOTICE
Any notice to you or to RxPG shall be made by either e-mail or regular mail.
Clause 14
FURTHER ASSISTANCE
Each party shall promptly execute all documents and do all things that any other party from time to time reasonably requires of it to effect, perfect or complete the provisions of these Terms and Conditions and any transaction contemplated by it.
Clause 15
ACKNOWLEDGE YOU ARE OVER 18 OR IF NOT, HAVE PARENTAL CONSENT
You acknowledge that as a Participant / Site visitor either :
15.1. You are 18 years of age or over, or
15.2. You are under 18 years of age but have the permission of a parent, guardian or other person with parental responsibility for you to use THE SITE.
